  1. GENERAL PROVISIONS<\/strong><\/li>\n<\/ol>\n

    These regulations govern the terms and conditions of participation in the \"Digital exhibition of memories\" (hereinafter referred to as: \"Award Competition\") organised by the company Esplanade Oleander d.o.o. (LLC) for tourism, catering and trade, with its registered office at the address Ul. Antuna Mihanovi\u0107a 1, 10000 Zagreb, ID no. (\u2018OIB\u2019): 08308894711 (hereinafter referred to as: \"Organiser\").<\/p>\n

    1. PURPOSE OF THE AWARD COMPETITION<\/strong><\/li>\n<\/ol>\n

      In celebration of the 100th anniversary of the Esplanade Zagreb Hotel, a Digital Exhibition of Memories and a competition are being organised to promote the hotel, its services, and its rich historical and cultural heritage. The Digital Exhibition of Memories aims to encourage citizens of Zagreb, guests and the general public to share their personal memories and experiences related to the hotel - whether through photos or videos, old items (such as keys, menus, invoices, postcards, etc.) or other content that emphasizes the importance and uniqueness of the Esplanade over the last 100 years. The collected content will be used to create an online exhibition marking the hotel's centennial, further promoting the historical value of the Esplanade as a symbol of Zagreb, the hotel industry, and its long-standing tradition of excellence. In addition to posting on the website, the Esplanade Hotel will share with its followers the most notable memories (photos, stories and videos) on the hotel's social media profiles (Instagram, Facebook, LinkedIn or TikTok), while giving credit to the owner of the content or post. Competition participants will have the opportunity to win fitting prizes, which further encourages engagement and interaction with the target audience, all within the framework of the Organiser's lawful promotional activities.<\/p>\n

      1. DURATION AND SCOPE OF THE AWARD COMPETITION<\/strong><\/li>\n<\/ol>\n

        The award competition will run from 10 July 2025 to 10 November 2025 and will take place in the territory of the Republic of Croatia. The organiser will release the rules of the award competition through public media and on the official website www.esplanade.hr<\/a>.<\/p>\n

          \n
        1. AWARD FUND<\/strong><\/li>\n<\/ol>\n

          The total value of the prize fund amounts to 7.552 EUR. The prize fund consists of the following prizes:<\/p>\n

            \n
          • Weekend overnight stay with breakfast in the Presidential Suite of the Esplanade Hotel Zagreb including a romantic dinner for two at Zinfandel's restaurant\n(average value of EUR 3,047).<\/li>\n
          • 2 x Weekend overnight stay with breakfast in the Deluxe Suite of the Esplanade Hotel Zagreb including a romantic dinner for two at Zinfandel's restaurant\n(average value of EUR 899).<\/li>\n
          • 2 x Sunday Brunch at Zinfandel's with a welcome glass of sparkling wine for two people. \n(value of EUR 308). <\/strong>(u vrijednosti 308 EUR).<\/li>\n
          • Lunch or dinner at Zinfandel's Restaurant for two people - Selection of three courses from the \u00e0 la carte menu with a welcome glass of sparkling wine and wine as recommended by the Sommelier, as well as water and coffee (average value of EUR 247).<\/li>\n
          • Lunch or dinner at Le Bistro restaurant for two people - Selection of three courses from the \u00e0 la carte menu with a welcome glass of sparkling wine and wine as recommended by the Sommelier, as well as water and coffee (average value of EUR 206).<\/li>\n
          • 3 x Daily Menu (Menu de Jour) at Le Bistro for two people (value of EUR 84)<\/li>\n
          • 5 x Breakfast for two at Zinfandel's Restaurant (value of EUR 52)<\/li>\n
          • 3 x Orient Express Afternoon Tea at Esplanade 1925 Bar for two (value of EUR 45)<\/li>\n
          • 10 x Esplanade \u0161trukli and a glass of house wine at Le Bistro for two people (value of EUR 40)<\/li>\n<\/ul>\n

            Prizes can be used within 6 months of the gift voucher being issued.<\/p>\n

              \n
            1. RIGHT TO PARTICIPATE<\/strong><\/li>\n<\/ol>\n

              Any adult individual, regardless of their country of permanent residence, is eligible to participate in the award competition.<\/p>\n

              Persons involved in the organisation and preparation, employees of the Organiser, and their immediate family members are not allowed to participate in the Award Competition.<\/p>\n

              1. HOW TO PARTICIPATE
                <\/strong><\/li>\n<\/ol>\n
                  \n
                • Photo submission: Participants may submit copyrighted photos and video content that they have taken themselves and for which they own the copyright. The photo or video must comply with basic rules for using images on the internet and must not contain inappropriate, offensive or illegal content. By submitting a photo or video, the Participant confirms that they are the exclusive copyright holder and grant the Organiser of the Award Competition the right of ownership free of charge and, to the widest extent permissible under the regulations of the Republic of Croatia, the exclusive right unlimited by content, time and space to exploit, with the full right of transferring, the photo\/video\/story, for any purpose of the Award Competition and for any type of subsequent promotion or campaign of the Organiser and\/or its products in any media, free of charge. Participants\/winners agree that they will not seek to exercise their moral rights regarding such exploitation or use of the photo\/video\/story where their moral rights exist related to such content. Participants\/winners guarantee that their photo\/video\/story has not been previously published or used in any part and that the material does not contain copyrighted material, that it is their original work, it has not been copied in whole or in part from any third party and that they have the authority to grant these rights.<\/li>\n<\/ul>\n
                    \n
                  • Writing a story: In addition to the submitted photo or video, participants can also submit a short story (up to a maximum of 150 words) that describes or is in any way related to the photo or video. The story should be true, creative or interesting and may not contain any inappropriate, discriminatory or offensive content. The participant confirms that he\/she is the author of the submitted text and that he\/she does not infringe on the copyrights of any third parties.<\/li>\n
                  • How to submit: Photos, videos and stories must be submitted through the official website of the Esplanade Zagreb Hotel, by completing the official submission form. All entries must be submitted within the competition period, as defined in these Regulations. Applications delivered after the specified deadline will not be considered.<\/li>\n<\/ul>\n

                    The Participant shall apply through the online form on the Esplanade Hotel website. Once the application is verified by a hotel official, within 72 hours of application, the post will be published on the website and possibly on social media profiles, or it will be stopped in case of violation of rights.<\/strong><\/p>\n

                      \n
                    • Additional terms: The organiser reserves the right to verify the authenticity of submitted photos, videos and stories, and to disqualify participants in case of suspected violation of the rules, including but not limited to false representation of authorship, use of other people's work without permission, inappropriate content, etc.<\/li>\n<\/ul>\n
                        \n
                      • When registering on the hotel website, the Participant must provide the following information:<\/li>\n<\/ul>\n
                          \n
                        • That they are an adult person<\/span><\/li>\n<\/ul>\n
                            \n
                          • That the material is owned by the applicant or that they hold the copyright, and that by applying for the award competition they give the hotel the permission to publish the uploaded content on websites and social profiles<\/span><\/li>\n<\/ul>\n
                              \n
                            • That the material aligns with the theme of the Award Competition<\/span><\/li>\n<\/ul>\n
                                \n
                              • That they agree to the Organiser collecting, processing, and publishing their personal data based on the consent that they provided as a condition for completing the application to participate in the Award Competition, identifying, and making contact for the purpose of delivering the prize should they become a winner in the Award Competition, whereby these data may be shared with a third party on a one-time basis (name and surname, address, telephone number), and the Organiser may also use them for promotional purposes related to this Award Competition.<\/span><\/li>\n
                              • That they agree with the Hotel's Privacy Policy and the use of personal data for the purposes of the Award Competition\n<\/li>\n<\/ul>\n
                                  \n
                                1. DISQUALIFICATION<\/strong><\/li>\n<\/ol>\n

                                  The Organiser will review all photos\/videos\/stories submitted for the Award Competition and reserves the right to disqualify participants at any time in the following cases:<\/p>\n

                                  - if the submitted photo\/video\/story does not cover the topic and comply with the terms of the Award Competition,<\/p>\n

                                  - if the photo\/video\/story contains inappropriate content,<\/p>\n

                                  - if the submitted photo\/video\/story contains offensive or vulgar content,<\/p>\n

                                  - if the submitted photo\/video\/story in any way expresses (or disparages someone else\u2019s) religious and\/or political beliefs,<\/p>\n

                                  - if the submitted photo\/video\/story falsely represents people, companies or products,<\/p>\n

                                  - if the reported photo\/video\/story contains content that is not in accordance with the law,<\/p>\n

                                  - if the application was submitted after the Award Competition ended,<\/p>\n

                                  - if the participant provides incorrect information about whether they are a minor\/adult,<\/p>\n

                                  -if the participant violates these rules in any way.<\/p>\n

                                  The Organiser is authorised, at its own discretion to disqualify, any participant at any time and without explanation, if they violate the regulations in force in the Republic of Croatia or their actions damage the reputation or harm the interests of the Organiser.<\/p>\n

                                    \n
                                  1. SELECTING WINNERS<\/strong><\/li>\n<\/ol>\n

                                    The award winners will be selected based on votes collected both from the Award Competition participants and individuals not participating in the Award Competition. Voting will take place through the voting mechanism on the official website of the Esplanade Hotel Zagreb. The participant whose post, photo or video garners the highest number of votes will be declared the winner of the main prize (from Point 4 of the Prize Fund 1st prize). The participant with the second highest number of votes will win the second prize (from Point 4 of the Prize Fund 2nd prize). The same principle will apply to other prizes according to the predetermined prize fund (listed under Point 4 of these Rules). In the event of an equal number of votes for a particular place, the winner will be determined by a three-member committee appointed by the Organiser based on a free assessment. The Organiser reserves the right to annul votes for which there is reasonable doubt that they were obtained through manipulation or in a manner that is not in accordance with the rules of the award competition.<\/p>\n

                                    1. PUBLISHING RESULTS AND TAKING OVER PRIZES<\/strong><\/li>\n<\/ol>\n

                                      The names of the winners will be published on the Organiser's official website within two to five business days after the Award Competition concludes. Winners are required to claim their prize within one month of the results being announced. If a winner does not claim the prize within the stipulated deadline, the Organiser shall notify them in writing and set an additional deadline of 8 days for claiming the prize. In the case of winners not contacting the Organiser within the additional deadline, they will forfeit their right to the prize, and the prize shall be awarded to the next ranked participant. Prizes cannot be exchanged for money or other services, and winners cannot request any exchange for other products.<\/p>\n

                                      1. LIABILITY AND RIGHTS OF THE ORGANISER<\/strong><\/li>\n<\/ol>\n

                                        The Organiser does not assume liability for any incorrect or incomplete applications.<\/p>\n

                                        The Organiser assumes no liability for the publication of photographs, materials or recordings in which the Participant infringes upon the any intellectual property rights of third parties, such as copyright, patent or protected trademarks of any third parties. The Organiser has the right to remove such content without explanation. Additionally, the Organizer has the right to remove, without explanation, any content that, in its judgement, constitutes an application with inappropriate content, such as insults based on racial, religious or any other grounds.<\/p>\n

                                        Applications that will be particularly considered as having inappropriate content include, but are not limited to, the following: applications containing violence or allusions to violence, applications with sexual content or insinuations that could allude to sex or violence, applications implying or indicating a breach of intellectual property rights, such as copyright and related rights, content that is contrary to the Constitution of the Republic of Croatia, the laws of the Republic of Croatia, societal morals, content that suggests racial, national, religious or other forms of intolerance, and similar content.<\/p>\n

                                                 <\/strong><\/p>\n

                                          \n
                                        1. ORGANISER\u2019S DISCLAIMER<\/strong><\/li>\n<\/ol>\n

                                          The Organizer will not be held liable for, and will not consider, late, incomplete, damaged or undelivered applications. The Organizer will not be held liable for any disruption, interruption or unavailability of networks, servers, internet service providers (ISPs), websites or other connections, technical failures or difficulties with hardware or software or any other failures or difficulties of any kind, whether human, mechanical, electronic, computer, network, typographical, printing or in any other way related to the Award Competition, including, but not limited to, any errors or difficulties related to the management of the Award Competition.<\/p>\n

                                          The Organizer will not be held liable for any possible inaccuracy in information if it arises from actions by website users, unauthorised handling or hacking of programs related to the Award Competition.<\/p>\n

                                          By participating in the Award Competition and accepting these rules for participation, the Award Competition Participant acknowledges and fully accepts that they are not entitled to any compensation for costs and\/or any form of damage from the Organiser that may incur to them while completing the task prescribed in this Award Competition.<\/p>\n

                                            \n
                                          1. RIGHT TO TERMINATE THE COMPETITION<\/strong><\/li>\n<\/ol>\n

                                            The Organiser reserves the right to cancel, terminate or suspend the Award Competition due to force majeure (occurrence of extraordinary, external or unforeseeable circumstances that could not have been foreseen, prevented, avoided or eliminated), malware infection, computer error, manipulation, unauthorised intervention, fraud, technical failure, human error beyond the Organiser's control, if this jeopardizes the management, security, fairness, ethics or proper staging of the Award Competition, of which the participants will be notified in a timely manner via the official website.<\/p>\n

                                            1. PERSONAL DATA PROTECTION<\/strong><\/li>\n<\/ol>\n

                                              The data controller is the company Esplanade Oleander d.o.o. (LLC) for tourism, catering and trade, with its registered office at the address Ul. Antuna Mihanovi\u0107a 1, 10000 Zagreb, ID no. (\u2018OIB\u2019): 08308894711.<\/p>\n

                                              By participating in this Award Competition, each participant agrees that, if they become a winner in the Award Competition, their personal data: full name, will be published on the Organiser's website and the Hotel's social media profiles (Instagram, Facebook, LinkedIn or TikTok), based on the Organiser's legitimate interest. <\/p>\n

                                              By participating in this Award Competition, the Participant is aware that the Organiser collects, processes, and publishes their personal data based on the consent that they provided as a condition for completing the application to participate in the Award Competition, identifying, and making contact for the purpose of delivering the prize should they become a winner in the Award Competition, whereby these data may be shared with a third party on a one-time basis (full name, address, e-mail address, telephone number), and the Organiser may also use them for promotional purposes related to this Award Competition. Such third parties include suppliers commissioned by the Organiser to fulfil the purpose of collecting personal data. The Organiser, in its capacity of the data controller for the implementation of this Award Competition, employs data processors who guarantee the implementation of appropriate technical and organisational measures to a satisfactory degree. The participant's personal data will not be used by a third party for any purpose other than those stated here. The Organiser will retain all personal data collected in this Award Competition in the storage system until the expiration of the deadline for filing any claims regarding this Award Competition, or for a maximum of twelve (12) months after the end of the Award Competition.<\/p>\n

                                              In accordance with the provisions of the General Data Protection Regulation (EU) 2016\/679, the participant has the right to request correction of data at any time, access to data relating to them, erasure of data, the right to lodge a complaint, and the right to suspend data processing. The Participant is free to withdraw their consent to the collection and processing of personal data at any time and acknowledges that such withdrawal may result in the inability to participate in the Award Competition. The Organiser has the obligation to ensure the deletion of any submitted personal data obtained from participants in the event that a participant requests the suspension of data processing.<\/p>\n

                                              When exercising rights related to personal data, the Participant may first request the exercise of their rights from the data controller via the e-mail address: info@esplanade.hr.<\/p>\n

                                              Additionally, the Participant has the right to submit a complaint to the Personal Data Protection Agency (AZOP), with headquarters in Zagreb, at the following address: Selska cesta 136, 10000 Zagreb, phone 00385(0)1 4609 -000, and e-mail address: azop@azop.hr. Participants' personal data may be processed during the Award Competition, and after, for the purpose of holding the Award Competition. Providing personal data is voluntary, but if the Participant refuses to provide any personal data that is defined as mandatory for holding this Award Competition, they will not be able to participate in the Award Competition.<\/p>\n

                                              1. JURISDICTION OF THE MUNICIPAL COURT IN CASE OF DISPUTE BETWEEN THE ORGANISER AND PARTICIPANTS OF AWARD COMPETITION<\/strong><\/li>\n<\/ol>\n

                                                Any disputes between the Organiser and the participants in this Award Competition will be resolved amicably or, should that not be possible, disputes will be resolved through legal means. The competent court for all disputes shall be the Municipal Court in Zagreb.<\/p>\n
